Whistleblowing system
The recent Legislative Decree no. 24/2023 introducing the new Whistleblowing Discipline in Italy, which has come into effect on 30 March 2023, regulates the new methods for the management of whistleblowing channels and the protection granted to whistleblowers, both in the public and private sectors.
The measure, which implements the latest European Directive 2019/1937 on the subject, defines more precisely both the violations that can be reported, the protections in favour of the whistleblower and the other parties involved in the reports and, above all, obliges companies to set up specific protected channels to receive and manage reports of violations of the rules.
The new rules then gave ANAC a role in, among other things, verifying the application of the rules.
The system adopted by Inmatica S.p.A. therefore complies with the requirements of Legislative Decree 24/2023, which transposes Directive (EU) 2019/1937 on “the protection of persons who report breaches of Union law and lays down provisions concerning the protection of persons who report breaches of national laws”.
Employees and third parties may use the methods indicated below to report any issues relating to non-compliance with the provisions of the Organisational Model, Code of Ethics and Company Procedures adopted by Inmatica S.p.A., as well as any violations of national and European Union regulations.
Reports will be dealt with in accordance with the procedure adopted by Inmatica S.p.A. and the following documents, which can be consulted on the website Whistleblowing Procedure – Confidentiality and Safeguards – Procedure Flow – Privacy Policy.
Inmatica provides for the use of alternative reporting systems for whistleblowers: oral form – meeting request (the whistleblower may request a personal meeting with SGS to present the report) – traditional mail (the whistleblower may write directly to the Supervisory Board).
